Terms & Conditions of Hire

1. Equipment Responsibility
I accept full responsibility for all equipment rented to me.
I agree to return all equipment in the same condition in which it was received.
I will cover the cost of any damage, loss, or misuse of the equipment while in my care.
2. Right to Cancel
Fun-FX reserves the right to cancel this agreement if negligence or misuse of equipment is suspected.
3. External Conditions
Fun-FX is not liable for any interruptions due to adverse weather, or disruptions to water or power supply.
No refunds will be issued for equipment damaged due to power surges.
4. Cancellations & Rescheduling
Bookings cancelled within 10 days of the delivery date are non-refundable.
Such bookings may be rescheduled up to two times; thereafter, the deposit will be forfeited.
5. Equipment Return
All equipment must be returned or made available for collection on the agreed collection date. Failure to do so will incur additional rental charges at the daily rate listed on our website: www.fun-fx.co.za
6. Weather Precautions
In the event of rain, all electrical equipment must be switched off immediately and brought indoors. 
The screen must be turned off or taken down in strong wind conditions.
After the movie, all electrical items must be brought indoors to prevent damage from rain or dew. I accept liability for any resulting damage.
7. Collection
Equipment will be collected the following morning before 12h00 (noon).
If the equipment is not available at this time, I understand that an additional day’s rental will apply.
8. Screen Visibility
I acknowledge that the screen is only visible from sunset onward, unless used in a fully darkened indoor environment.
9. Media Responsibility
I am solely responsible for the content shown using the rented equipment and will ensure compliance with copyright laws. For assistance regarding licensing, I will contact the Motion Picture Licensing Company (MPLC). 
10. Personal Verification
I give consent for Fun-FX to verify the information provided and to make a copy of my ID upon delivery. The ID presented must match the booking details.
11. Security of Equipment
Equipment must not be left unattended in shared or communal areas, including complexes or apartment buildings.
12. Risk Acknowledgement & Liability Waiver
I understand and accept that: All participants and guests at the event engage with the equipment at their own risk.
Fun-FX shall not be held liable for any injury, loss, or damage to persons or property arising from use of the equipment.
I waive any and all claims against Fun-FX related to such events or incidents.
I confirm that the delivery address, event date, and contact information provided are accurate.
I indemnify Fun-FX against any legal claims resulting from the event.
13. Dispute Resolution
Any disputes arising from or relating to this agreement shall be referred to arbitration. 
A single arbitrator will be appointed by: Mutual agreement between both parties; or if no agreement is reached within 5 days, by the Chairperson of the Association of Arbitrators (Southern Africa).
The arbitration will be conducted in accordance with the Association of Arbitrators (Southern Africa) Summary Procedure Rules, which both parties agree to abide by. This arbitration clause remains binding even if this agreement is cancelled by either party.
14. Entire Agreement
This agreement constitutes the full understanding between Fun-FX and the undersigned. No amendment, variation, or cancellation will be valid unless made in writing and signed by both parties.
